Terms of Service

1. Acceptance of Terms

By accessing or using the Instant Genius Receptionist platform ("the Service"), operated by The Von AI LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

2. Description of Service

Instant Genius Receptionist provides AI-powered receptionist services, including but not limited to: answering inbound calls and text messages, booking and managing appointments, sending reminders and follow-up messages, processing deposits, syncing with Google Calendar, and managing client communications on behalf of subscribed businesses.

3. Subscription & Billing

• Business clients subscribe to a monthly plan (Starter, Growth, or Pro). Pricing is displayed at the time of subscription.
• An initial setup fee may apply, payable in full or via installment plans (Klarna/Afterpay) where available.
• Monthly subscriptions auto-renew until cancelled. You may cancel at any time by contacting hello@instantgeniusreceptionist.com.
• Service deposits collected from end customers are processed via Stripe and deposited directly to the business client's connected Stripe account, minus applicable platform and processing fees.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, or federal law
• Send unsolicited marketing messages (spam) through the Service's SMS, voice, or email channels
• Attempt to access, tamper with, or disrupt the Service's systems, data, or security
• Resell or sublicense the Service without written permission
• Use the Service to transmit content that is harassing, defamatory, or otherwise objectionable

5. SMS & Voice Communications

The Service sends SMS messages and places voice calls on behalf of business clients. End customers (patients, callers, leads) may opt out of SMS at any time by replying STOP. Business clients are responsible for ensuring they have proper consent to contact their customers.

Message and data rates may apply to end customers. The Service is not responsible for carrier fees charged to end customers.

6. Third-Party Integrations

The Service integrates with third-party platforms including Google Calendar, Stripe, Twilio, OpenAI, ElevenLabs, and Resend. You are responsible for maintaining your own accounts and credentials with these providers. We are not liable for disruptions caused by third-party service outages or policy changes.

When connecting Google Calendar, you grant the Service permission to create, modify, and delete calendar events on your behalf. You may disconnect at any time.

7. AI-Generated Content

The Service uses artificial intelligence to generate conversational responses, appointment summaries, and other content. AI-generated content may occasionally contain errors. We do not guarantee the accuracy or completeness of AI-generated responses. Business clients are responsible for reviewing and correcting any inaccurate information communicated to their customers.

8. Data & Privacy

Our handling of personal data is described in our Privacy Policy. By using the Service, you consent to the data practices described therein.

9. Limitation of Liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, The Von AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or profits, arising from your use of or inability to use the Service.

10. Indemnification

You agree to indemnify and hold harmless The Von AI LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may cancel your subscription at any time.

12. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Harris County, Texas.
